Jury keeps death penalty as option for Colorado movie gunman Holmes

Accused Aurora theater gunman James Holmes listens during his arraignment in CentennialJames Holmes, the Colorado movie massacre gunman, could face the death penalty after jurors found on Monday that aggravating factors including the cruel nature of his crimes counted for more than mitigating ones such as mental illness. The panel of nine women and three men will now hear from victims of the July 2012 rampage at a midnight screening of the Batman film "The Dark Knight Rises." They will then deliberate on whether the 27-year-old shooter should be executed by lethal injection. Holmes, who killed 12 people and wounded 70, showed no reaction as the verdicts were delivered, staring straight ahead, hands in pockets.

Senate Democrats succeeded in stopping the bill on a procedural vote. It received 53 votes, with 46 senators opposing it.

University of Cincinnati police officer Ray Tensing's body camera shows driver Samuel Dubose pulled over during a traffic stop in CincinnatiDuBose was pulled over by police officer Raymond Tensing on July 19 because the vehicle he was driving did not have a front license plate. DuBose handed him the bottle, marked as gin, and told him it was air freshener. About a minute later, the two men struggled after DuBose, 43, refused Tensing's request to step out of the car.
